As every coin has two sides. similarly, UAPA also has two sides. there are two groups one in support and another one who is still not agree that UAPA is beneficial.
group one believes that, tougher laws are needed to tackle the terrorism, hence believes that UAPA is perfect act.
group two is not on the same page and believes that this can be misused against minorities, human right activists and mainly can be dangerous for those who are literally innocent but had put behind the bars only on the basis of doubts.
Let's just find out the origin from where it all started...
let's get back to year 1967, UAPA was just introduced by national integration council (NIC) to parliament.
objective of the then UAPA :
1. if there is any terrorist organisation ban it.
2. If any individual supports unlawful activities he/she will be punished accordingly.
3. penalty will be there in case someone continues.
since 1967 UAPA got 6 amendments in 1969 1972 ,1986 , 2004 , 2008 and 2013 respectively.
now, talking about today's UAPA ...
It deals with :
1.unlawful act
2.terrorist act
Earlier in 1967, UAPA used to punish unlawful acts and ban unlawful organisation. after several amendments, "terrorists act" and "terrorist organisation" got added.
Let's get into detail of terrorist acts :
terrorist acts involves :
1.whoever threatens integrity, unity, security and sovereignty of India.
2.destruction of any property.
3.organisation or individual involves in death, injury of any person who distrupts supplies or services essential to the life of community in India.
*What will be punishments to individual or organisation for terrorists act :
1.if resulted in death, hence punishment will be similar "imprisonment for life" and also liable to fine.
2.in other cases, imprisonment for 5 years and shall be liable to fine.
*notable arrest under the act/people who got booked under UAPA.
they are total 22 arrest since 2009 and most of the arrests are in 2018, 2019 and 2020.
list of the people who got booked under UAPA are as follows :
1.Maoist kobad ghandy
2.Arun ferreira
3.Binayak sen
4.Gaur chakraborty
5.Thirumurgan gandhi
6.Sudhir ghawale
7.Mahesh raut
8.Shoma sen
9.Surendra gadling
10.Roma wilson
11.Sudha bhardwaj
12.Varavara rao
13.Gautam navlakha
14. Akhil krishak mukti sangram samiti
15. Alan suhaib and taha fasal
16. Madrat zahra
17. Anandh teltumbde
18. Meeran haider and safoora zargar
19.Sharjeel imam
20.Devangana kalita
21.Gurupatwant singh pannum and hardeep singh
22. Umar Khalid
Perfectly penned every aspect of this law. Exactly it also has two sides for which it should be mend so that misusing of this act can be stop.

DeleteSimple and clear and informative too but can focus more on why it has two sides and why critics are against this uapa and Uapa role during 2020..

DeleteGrt effort but you should mention how a government agencies can misused it,and how a person can be booked under this UAPA.
ReplyDeleteThank you for the appreciation... Government agencies can misuse it as this UAPA got rigid after the amendment of 2013, it says that anyone can be booked under this UAPA only on the basis of doubt .
